Criminal Injury Claim
The Criminal injury Compensation board is a Government
appointed, public funded organisation that pays compensation to
innocent people who have been physically or mentally injured as a
result of a crime which took place within Scotland, England or
Wales.
There are 25 levels of criminal compensation for which they pay
out from £1000.00 to £250,000.00 to victims of criminal injury. The
maximum amount you can receive in criminal injury compensation
after all losses and expenses have been considered is £500,000.
When looking to make a criminal injury claim for compensation
there are specific guidelines to consider.
You may be entitled to compensation if you:
- Have been injured seriously enough to qualify for at least the
minimum award (£1,000)
- Have been assaulted or injured in a way which is covered by the
Criminal Injuries Compensation Scheme (2008) and, as a result, have
suffered physical or mental injury
- Were injured in an act of violence in England, Scotland or
Wales
- Have received fully documented medical attention for the
injuries
- Were a dependant or a relative of a person who died as a result
of the incident
- Reported the incident to the Police within 48 hours
- Submit your application for an award within 2 years of the
incident
If you have been injured because of a violent crime,
there are four possible types of compensation you might be able to
claim:
- Compensation for injuries (including sexual offences)
- Compensation because a loved one has died as a result of a
violent crime
- Compensation for loss of earnings
- Special expenses (e.g., the cost of medical treatment, cost of
care, the cost of adaptations that need to be made to your home as
a result of your injury)
