Faulty Product Claim
Any product or service you buy must be fit for its purpose, it
must appear and work as described and it must be of a satisfactory
quality.
Unfortunately, this is not always the case and every year in the
UK a significant number of people are injured as a result of faulty
or defective products.
If you've been injured or have suffered serious illness
due to a faulty or defective product, you could be entitled to
claim compensation if you were not to blame.
Examples of faulty products or services
include:
- Burns due to faulty electrical appliance
- Child choking on the eye of a doll
- Broken limb due to defective ladder or faulty furniture
- Scarring caused by contaminated cosmetics
- Injury from accident caused by faulty vehicle (eg, car,
bicycle)
- Food poisoning caused by contaminated food bought in a
shop
If you suffer in an accident from a faulty product, the Consumer
Protection Act 1987 allows you to make a claim against the
manufacturer for their faulty or defective product. Thiis known as
a 'product liability claim'.
4 Types of Product Liability Claim
There is more than one type of faulty or defective product
claim. These include:
- Failure to recall a defective product
- Failure to display a warning on the product or make the
customer aware of this
- Damage to the product during manufacture
- Poor design
If you want to make a faulty product claim for an injury due to
a faulty product or service, keep all documents that may relate to
your claim, including packaging, instructions and
receipts.
How long to claim?
Your claim must be made within 3 years of the date of your
injury or, in the case of children, 3 years after their 18th
birthday.
