Personal Injury Questions
Q.
Why choose Davies & Gribbin to be my accident
solicitor?
A. We are one of the leading firms in our
field and have built a reputation, which is second to none,
through our previous successes. We are regulated by the Solicitors
Regulation Authority and employ members of the Association
of Personal Injury Lawyers (APIL), so you can be sure that
you will receive the highest standards of service at all times.
With us, you will receive 100% of your damages. Unlike
some firms, we will not deduct one single penny of your personal
injury compensation for our costs and, in the unlikely event
that we lose, you will still not be charged.
We represent more than 3,000 people each year on this basis and
have tens of thousands of satisfied clients.
Q.
Will I deal with you directly?
A. YES - When you make an online claim,
your details arrive on the desk of one of our own dedicated
legal professionals, who will then call you back.
Beware of the hundreds of Claims Management companies that will offer
to handle your claim for you. They are simply middlemen who
charge solicitors, like ourselves, a large fee for referring
your claim and usually have no legal training.
Q. How
much will my accident claim cost me?
A. NOTHING - If your claim is successful, we will recover all our costs
from the other side. Furthermore, Davies & Gribbin Solicitors
operate on a no
win no fee basis so, in the unlikely event that we don't win your case,
you still won't pay our legal fees.
Q. Can I claim if I live outside England and Wales?
A. YES. As long as the accident happened
in England or Wales, we can accept your claim.
Q. How do I make a claim?
A. The fastest way to make a claim is to complete our online claim
form. If you would rather talk to a member of our staff first, please call us FREE on 0500 003 972.
Q. What happens after I submit my online claim?
A. If you gave an email address, you should receive confirmation
of your claim by email within minutes and can expect to hear
from us by telephone within 48 hours on the number you provided. Please make sure you are available!
Q. What damages can I claim for?
A. If you have been injured and someone else is to blame, you can
claim compensation for your injuries, the cost of medical
fees and any other losses, including loss of earnings.
If your injuries are the result of a car
accident, your compensation may also include the cost
of vehicle replacement, repairs, recovery and storage, retention
of your no-claims bonus and retention of your insurance excess.
Q. How much will I get?
A. Unfortunately, without knowing the precise extent of your injuries, it is
impossible to say. However, as an example, for clients who
have relatively minor whiplash type injuries from a road accident
and a recovery of about 6 months, we are usually successful
in recovering damages in the region of £1,200 to £1,700.
A typical whiplash
injury may take up to a year from which to fully
recover. In such cases, you could expect damages of £2,000
to £2,500. In addition we will claim any other losses
(e.g. wages, medical treatment, lost excesses) on your behalf.
See our injury compensation guide for more examples.
Q. Who do I claim against?
A. This depends on the circumstances of
your accident. Typical examples are:
- If you are the victim of a car
accident, you can claim against
the other driver;
- If you trip
on a pavement, a claim may be made against the
local council;
- If it was a medical accident, you may have to claim
against the hospital, GP or dentist involved;
- If you slip on flooring in a shop, then you may
sue the shop or the owner of the property
where you were injured.
Don't worry if your circumstances are not listed above. These are
just examples. CLAIM NOW to see if you are entitled
to compensation.
Q. What
if the accident was nobody else's fault?
A. If there is any doubt that the accident was NOT your fault, we
won't be able to help you on this occasion. In this instance,
if you have had a road traffic accident, you should contact
your insurance company and follow their advice.
Q. How
long do I have after my accident to make a claim?
A. You have 3 years from the date of your
accident to make a claim. If you were under 18 years of age
when the accident happened, you have until your 21st birthday
to make a claim for compensation (see our page on child
injury).
Q. What
if I am the victim of a criminal assault?
A. If your injuries are the result of a
criminal assault, this is known as a CICA
claim. We will then refer you to Victim
Support and the Citizens
Advice Bureau.
